The Signing of Marriage Contract in Muslim Matrimony

A perfect Islamic marriage is dependent on a few important rituals. It starts from the step of proposal, to the mehr and ultimately to the Nikahnama ceremony. The proposal by a groom to the bride's wali is the step one of an Islamic marriage. It is considered a matter of pride between the two families. Once the family of the bride welcomes the proposal, then the proposing groom gives Mehr to the bride. Mehr is a demand for gifts submitted by the bride and it is her legal right to demand it, prior to the Nikahnama commemoration occurs. This present must be mutually agreed upon between both the couples, as it is a gift and not dowry or any price of exchange. However, it may be en-cashed according to the Islamic Marriage Contract  between the two parties .

The Muslim Marriage Contract aims to assist the difficulties and dismay in many British Muslim families today by making clear the legal rights and obligations of the spouses and by moving towards equal rights and justice in the family.

These are rights which are confirmed by the Shariah. These are also rights which are contained in the Muslim family law or personal status codes for Muslims in various countries.

Highlights of the Model Muslim Marriage Contract

Islamic law enables a Muslim male to wed up to 4 wives so long as he guarantees justice and equal rights among them.

To have a marriage validly recognized as per the Islamic law, the following are required to be fulfilled:
  1. The parties to the marriage should have accepted marry one another
  2. The consent of the bride's wali
  3. The groom must offer Mehr.
  4. Celebration of marriage should be witnessed by at least two witnesses.
When the above requirements are fulfilled, an Islamic law marriage is presumed to have occurred.
